The Patient Protection and Affordable Care Act

The Patient Protection and Affordable Care Act recently enacted by the US Congress has most of us concerned. Many of the provisions to this date still have unanswered questions and clarifications. While some provisions of this bill may change in the future, many of the provisions of this law become effective immediately (from now to September 2010).

We wish to keep our clients informed of new legislation which may impact the benefits offered to their employees. Many of the changes from this legislation are positive for residents of states where insurance regulation has been haphazard. Many of the insurance regulation reforms are already in effect in several states. Utah, Colorado, Nevada, Arizona and California have enacted laws to prevent abuses by insurance companies. Utah put in place an insurance exchange for use of its citizens that went into effect on January 1, 2010, however, the difficulties encountered by the exchanges have been many, including an increase in premium cost to the employer as high 30% in some cases. This bill faces many challenges over the next several years.

We have attached a schedule which shows a time line of changes this legislation will have on insurance plans offered through employers, as well as to individuals. Changes to our health care delivery system will continue to evolve; we will keep you informed as future updates become available.
